| 1. Novelbid.com is a free website. Usage requires agreement to terms. 2. The owner of Novelbid.com, hereafter referred to as Novelbid, may at any time, for any reason, change terms of use. 3. Novelbid may at any time, for any reason, inactivate or end an auction or temporarily or permanently suspend a user. Ending an auction may invalidate all prior bids to that auction. 4. The user (you) agrees not to sell any items deemed illegal in your state, county, or jurisdiction. 5. The user (you) agrees not to sell any items to minors (or individuals under age 21) who cannot legally possess or consume the item you are selling. 6. Novelbid does not manage payment transactions or tax liabilities of transacted items. The buyer and seller of the auctioned item are responsible for monetary exchange and any subsequent tax liability. This includes federal, state, and local tax liabilities from the sale. 7. Auctions represent an agreement by the seller to sell the listed item at the price the item generated by bidding, assuming bid price met or exceeded the item's reserve price. An auction can be cancelled by the seller at any time prior to the auction ending, regardless of how many bids have been placed on the item. A user's bid cannot be cancelled. Bids represent an agreement by the bidder to purchase the item at the bid price, provided that price has met the reserve price and no other bidders bid higher. The highest bidder obtains the right to purchase the auctioned item at the bid price, provided the bid price met or exceeded the reserve price. Upon the ending of an auction, arrangements should be made to exchange the sold item(s) for agreed upon price as soon as possible. Failure to comply with this may result in a temporary or permanent suspension. If an auction ends and the reserve price has not been met, the high bidder is not obligated to purchase the item. 8. In every item listed, the seller agrees to accurately describe the item for sale. This includes reference to any defects or deficiencies the item may have, or any lack of functionality the item has. Failure to comply with this term may nullify the auction and result in a temporary or permanent ban, which is at the discretion of NovelBid.com 9. Abusive language or behavior of any kind will not be tolerated, and may result in immediate suspension, depending on the severity of the abuse. Abusive behavior may include (but is not necessarily limited to) messages sent inside or outside of the NovelBid.com application. 10. Novelbid makes no guarantees about functionality of site or auctions. 11. As of January 16, 2021, Novelbid.com charges no fees for listing, selling, or buying items through it. This model may change at any time without notice. Such changes may include tiered services, limitations on free acounts (limited auctions per day, week, or month), or extended membership services, such as promoted auctions. 12. NovelBid.com collects a minimal amount of information from users, and may sometimes store that information in session variables (files stored on NovelBid.com's server) or "cookies" (files stored on the user's local computer). The user agrees to this information storage. 13. From time to time, NovelBid may post a fake auction. These items will be denoted with a prefix of "FAKE AUCTION." No bids placed on these items will be honored. These items do not fall within the confines of the above terms related to bids, requirements to pay, or obligation to sell. |
